Terms and condtions


General
Rippa Automotive Pty Ltd (ABN 72619631097) provides professional mechanical services for passenger vehicles, trucks, earth moving equipment and custom restorations by appointment. By booking your vehicle with Rippa Automotive, you accept these Terms and Conditions.
Estimates and Payment 
We provide an estimate of the cost of all work to be undertaken. The estimate will be discussed with you prior to work being commenced on your vehicle. Estimates remain valid for 7 days. All estimates and prices include GST.
Should additional work be found necessary during the course of the service which would cause the estimate to be exceeded, we will contact you to explain the additional work required and seek your authorisation for the additional costs to be incurred before proceeding.
A detailed tax invoice outlining the work carried out and associated costs will be provided once the work is completed. Payment must be made in full on the day of work being completed and prior to collection of your vehicle. We accept cash, credit cards, EFTPOS, and bank cheques. Bank details for direct deposit are at the bottom of invoice and payment must be received in our bank account prior to picking up vehicle. Payment made by Visa or Master card credit cards will incur a surcharge of 1.8%. Payment made by American Express credit cards will incur a surcharge of 3%. Personal cheques are not accepted.
Trading terms for customers operating an Authorised Trading Account are 14 days from date of tax invoice. Pleaser note that property in any product sold by Rippa Automotive to you does not pass from us to you until we have been paid in full.
Liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure. You are also entitled to have the goods repaired or replaced if the goods and/or services fail to be of acceptable quality and the failure does not amount to a major failure. To the maximum extent permitted by law, our liability for breach of any implied warranty or condition which cannot be excluded is restricted, at our option, to:
1. In the case of service supplied or offered by us, either
1. the re-supply of those services
2. the payment of the cost of having those services re-supplied
2. In the case of goods supplied or offered by us,
1. the replacement of the goods or the supply of equivalent goods
2. the repair of the goods
3. the payment of the cost of having the goods repaired
4. the payment of the cost of having the goods repaired
3. To the maximum extent permitted by law, we will not be liable to you or any third parties for:
1. any claim, whether that claim arises in, tort (including negligence) or statute
2. any loss (including loss of profits or special, indirect, incidental or consequential loss)
3. damage, injury or death to any person or property, arising out of or relating to the products sold by us or the services performed by us
Registration of your vehicle
In the event that your vehicle is not registered, you agree to inform us that your vehicle is not registered and should not be test driven by us. We will not be liable to you or any third party in respect of any claim for breaches of the relevant road traffic or other authority.
Lien 
You acknowledge that we have a lien (under general law or equity) over all products in our possession belonging to you, including your vehicle and all goods in or attached to your vehicle (“Lien”), to secure payment of any or all amounts outstanding from time to time.
You agree that we may, at our discretion, exercise the Lien in respect of any due and unpaid amounts outstanding by you and may retain your vehicle and/or any goods in your vehicle and serve notice on you requiring immediate payment of the amounts outstanding by you.
Storage and disposal of uncollected vehicles
If we exercise a lien over the vehicle or you do not collect the vehicle within 2 days from the time it is ready for collection a vehicle storage fee of $25.00 per day will apply.
If any amounts outstanding have not been paid within three calendar months of us providing notice to you, and if we do not hear from you after making reasonable attempts to contact you, we may sell your vehicle and/or all goods in or attached to your vehicle in accordance with any applicable legislation relating to the disposal of uncollected goods and vehicles.
In the event that we sell your vehicle and/or goods, we will apply the proceeds in the first instance to the satisfaction of the amounts outstanding by you and costs including but not limited to the costs of arranging and exercising the right of sale.
Authority in Respect of the Vehicle
You authorise us to do every act, matter and thing that we consider desirable or necessary for us to provide you with the products and/or services set out in the Service Authorisation in respect of your vehicle, including (but not limited to):
• access to and entering the vehicle;
• working on your vehicle;
• creating a suitable work space or environment to work on your vehicle; and
• test driving your vehicle.
Parts and lubricants
Rippa Automotive uses quality aftermarket parts and lubricants that meet or exceed the specifications of those originally fitted by your vehicle manufacturer. Should you wish to use an alternate brand or product, Rippa Automotive will take reasonable action to source that part or product for you, although this may impact on the pricing and time commitments of your car service or repair.
You understand that some vehicles require larger quantities or higher grade oil during servicing. Rippa Automotive may at its sole discretion, and without contacting you for authorisation, charge an amount to cover the cost of oil used in the service.
 
Matters outside our reasonable control
We will not be liable for any delay in performing, or any failure to carry our repairs to your vehicle to the extent that such delay or failure results from events or circumstances outside our reasonable control. You understand that when repairing your vehicle the power supply in your vehicle may be temporarily interrupted. This may cause your audio system to lock and require an unlock code. We will take reasonable steps to prevent this from happening however it is usually outside our control. The unlock code for your audio system will be your sole responsibility.
Privacy
We will comply with all applicable privacy legislation, including the Privacy Act 1988. Unless you indicate otherwise, you hereby consent to us using your personal information for the following purposes:
1. our internal marketing activities, including direct marketing, database compilation, analysis of demographics and the processing or creation of other marketing information;
2. customer surveys and individual follow-up calls, letters or emails enquiring as to your satisfaction with our products and services;
3. reminders that your vehicle may be due for a service or that your registration may be due for renewal;
4. advising you of information which may be relevant to you, including shop closures or openings; and
5. advising you of offers that we feel may be of interest to you.

Major Projects and Custom Restoration Work
Major projects include truck and vehicle repairs where significant part inputs (eg engines), outsourced services (eg engine reconditioning, painting) or extended time delays outside the control of Rippa Automotive are incurred.
Custom restoration work is by appointment and agreement. An agreement of services, parts, schedules and responsibilities will be agreed to between Rippa Automotive and the vehicle owner. Due to the nature of the work specific time frames and costs cannot always be made. Indicative costs and milestones will be given by Rippa Automotive prior to commencing each stage of the work.
Customers will be required to be approved as an Authorised Trading Account
Rippa Automotive reserves the right to:
• Request payment of parts prior to commencing the job and at regular intervals as set out in the service agreement
• Request payment of outsourced services prior to commencing outsourced service
• Progressive payments for services completed, invoiced at regular intervals
• Apply storage fees of $25 per day where progressive payments, payment of parts, outsourced services are not received within 14 days of invoice. This applies to where work cannot be completed due to delays outside the control of Rippa Automotive such as customer supplied parts not being supplied as agreed.
 
Warranty/Guarantee
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure. You are also entitled to have the goods repaired or replaced if the goods and/or services fail to be of acceptable quality and the failure does not amount to a major failure.
Our guarantee below is provided in addition to your rights under the Australian Consumer Law. The guarantee period applicable to the product or service may be indicated on the Service Authorisation or other communications.
Product / Service Guarantee Period
Car servicing and engine maintenance 12 months or 20,000km
Truck servicing and mechanical repairs 1-3 months
General mechanical repairs 12 months or 20,000km
Brakes (passenger vehicle only) 12 months or 20,000km
Suspension and steering (as per manufacturer’s warranty) Ranges from 12 to 24 months
 
We will repair or exchange (where possible) the product or service if it becomes defective within the guarantee period set out above. We will bear the reasonable costs incurred in claiming the guarantee.
This warranty will not apply:
• to normal wear and tear;
• where goods come to the end of their natural service life;
• to project restoration vehicles that are customised for the purpose of racing or built to customized client’s requested specifications that exceed the original manufacturer’s specification design;
• to maintenance items such as globes, wiper blades, lubricants and fluids; or
• customer supplied parts
• if you remove the part or parts originally fitted by Rippa Automotive
where the defect is a result of:
• alteration, accident, misuse, abuse or neglect;
• unsafe or inappropriate driving practices; or
• where the product or services are subsequently repaired or modified by an unauthorised service agent
